These Terms & Conditions ("Terms") govern your access to and use of the DataBeam website and lead-management platform (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & Accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for keeping your account credentials and API keys secure, and for all activity that occurs under your account.
2. Acceptable Use
- Do not use the Service to send spam or to collect data without the proper consent of the people submitting it.
- Do not attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure.
- Do not exceed published rate limits or otherwise abuse the API.
- Do not upload unlawful, infringing, or malicious content.
3. Your Content & Leads
You retain ownership of the forms you create and the lead data you capture. You grant us a limited license to host and process this content solely to provide the Service. You are responsible for the legality of the data you collect and how you use it.
4. Plans & Billing
Paid plans, where applicable, are billed in advance on a recurring basis. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.
5. Service Availability
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue features at any time.
6. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to others.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, DataBeam will not be liable for any indirect, incidental, or consequential damages, or for any loss of data or profits arising from your use of the Service.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of the Service constitutes acceptance of the updated Terms.
